Enforcement Services for ISVs
The Federation’s aim is to reduce the level of software theft so that our members can prosper in business, and be confident that their investment is being safeguarded.
Where the Federation receives reports of illegal sales or license infringements by companies or individuals, we will thoroughly investigate and liaise with the publisher concerned to achieve the desired result, often recovery of license fees to recompense.
Through our experience and contacts, we can provide guidance to publishers on options for actions whether based on the civil or criminal law and our early involvement can facilitate an early and acceptable resolution.
On application, member companies can be included in the on line investigations, such as the Operation Tracker programme, which investigates those unlawfully file sharing.
As a well respected authority on software intellectual property rights, the Federation can provide members with access to a network of expertise including investigatory, forensic and specialist legal resources, saving members time and effort in sourcing expertise.
Members can access experienced legal professionals through the Federation’s Legal Advisory Group (FLAG). This includes attending legal workshops on business software matters. Additionally Members can access papers on current legal issues written by FLAG with back copies available on the members’ website.
Our Legal Affairs Team support government enforcement agencies such as Trading Standards by providing guidance and expertise to assist them in investigating and prosecuting copyright abuses, including exposing unscrupulous traders in the reseller and distributor channels. Currently we are providing expertise and guidance to Trading Standards to enable them to use the powers granted under the implementation of Section 107A of the Copyright Design and Patents Act 1988 to investigate software abuses.
